The criminal justice wedding cake is a diagram to show the importance of a crime and where it would be categorized. There are four layers on the cake that signify each of the major types of crimes: (1) misdemeanors, (2) less serious felonies, (3) serious felonies, and (4) celebrated cases. Also, the size of these layers depends on the importance of the crimes, with misdemeanors being the largest and at the bottom and the celebrated cases being at the top and the smallest layer. The bottom and largest layer of the criminal justice wedding cake pertains to the misdemeanors.A misdemeanor is a lesser crime and the person being punished is given either a fine or a few days of imprisonment depending on the type of crime committed. Misdemeanors range from a number of different things from a possession charge to a minor traffic violation, like a hit and run accident with another person’s vehicle. But it depends upon the state that these offenses are listed as misdemeanors. The next la yer would consist of the less serious felonies. These are usually committed by first time offenders.Some of the cases include small robberies of a low dollar value with no weapons involved or something as simple as a fight that ended with assault charges. Most of the time, depending on the severance of the case, these felonies are not dealt with like they should be. The punishments for these types of cases are things like probation or home incarceration. The third layer of the criminal justice wedding cake would include the more serious felonies. Some of these crimes would consist of murders, high dollar robberies that involved weapons, such as bank heists or home invasions, or a probation violation.These felonies are taken very seriously and they often require a minimum sentence of at least one year in prison. At the very top of the cake rests the celebrated cases. These cases are the high-profile cases and they attract a lot of media attention. The people involved in them can incl ude someone famous, or very wealthy, like OJ Simpson, Martha Stewart, and Lindsey Lohan. Celebrated cases can also be someone unknown who committed a very wrongful crime like a serial killer, or simply because they attract the media.

It is true that Northrop Frye’s ideas about the way we speak and the function and levels of our language gives us something to think about and brings up the question of why different languages present such huge problems when there is a language barrier between those who are trying to communicate. Northrop demonstrates his own ideas about how to communicate better as he talks about language on a societal, individual and worldwide level. For those who have only spoken one language their entire life, to be presented with a new language can be thoroughly frustrating and confusing. One language can be so different from the other and trying to speak a new language can take a huge amount of time in studying the pronunciation of new words and trying to relay them to others with the same rhythm that they speak. A good example of the frustration and confusion of a language barrier, I witnessed in a shopping mall. The foreigner was trying so hard to get their message across to the sales clerk and only ended up leaving the store with disappointment. I noticed that the foreigner spoke slowly and tried to pronounce their words slowly and clearly as the sales associate just spoke in their usual manner and not putting any effort into speaking more slowly and clearly or even trying to use other, more simpler words which would have helped the foreigner, tremendously. Instead of opting to try other methods of communicating, the clerk only let the customer leave without hesitation. It seemed that the associate would rather lose money for the company, let the customer leave with frustration and avoid the entire incident, completely, rather than finding a better way to communicate. Another example of a racial language barrier, I witnessed at a gas station. This time the foreigner spoke loudly and quickly and the group in our immediate area only looked away or stared at the individual as if they were saying nothing at all. The foreigner this time, forgot to find a better way to communicate. I wondered if there was an emergency or a problem with this person that needed immediate attention from the people around, since they seemed desperate and frightened. There was not a single person in the area that spoke the same language as the person rambled on about something that we had no idea what they were speaking about. To me, this language barrier was extremely frustrating, as well and I felt bad that I couldn’t understand the message they were trying so hard to convey. They left the scene, without any help, just as the individual in the shopping mall who wasn’t able to communicate clearly enough and who didn’t have the proper listener who was willing to use a different method for communicating. In order to break the language barrier, it is so important that we learn to adapt to other cultures and become more patient and educated for different languages to be used and understood. Newcomers to a region are not always equipped with the proper language skills that they need to function properly in society and it is important for them to study the new language and practice for success in speaking the new language. They must learn to achieve goals by listening to people talk and adapting to the new speech. It will take patience and tolerance in learning the new language and with this in mind, they will become good speakers and will also be capable of learning to speak the language which will end the constant frustration and confusion.

The aim of Part B will be to first assess the benefits of gaining accreditation against the CMM for software companies, secondly explain why the CMM is important for Indian outsourcing organizations and provide examples of companies, and lastly critically evaluate the differences between the CMM and the TickIT scheme by identifying the strength and weakness of both methods. PART A 2. Capability Maturity Model (CMM) The Capability Maturity Model (CMM) was developed at Carnegie Mellon University by the software Engineering Institute (SEI) and it provides a frame work for process improvement. (8) 2. 1 Five levels of (CMM) CMM has five maturity levels that lay successive foundations for continuous process improvement. Looking at figure1 in 2. 2, we can see that each maturity level comprises a set of process goals that when satisfied, stabilize an important component at the software process. (9). The Capability maturity model is organized in to five levels. Below is a description of each one: * Initial (Level 1): At this level the software process is ad hoc and projects succeed through individual heroism. ( 8) * Repeatable (Level 2): At this level basic project management processes are established to track schedule, cost, and functionality. (9) * Defined (Level 3): At this level the software process for both management and engineering activities is documented, standardized and integrated into a standard software process for the organisation. Process improvement is an important Total Quality Management concept and significant research has focused on the design and evolution of the software development processes with the intent to enhance their capability and maturity. The Software Engineering Institute (SEI) has developed specific models to evaluate, diagnose, and evolve the capabilities of the software development process. (4) As mentioned in 2. 1, the SEIs Capability Maturity Model (CMM) defines an evolutionary path from ad hoc, chaotic processes to mature, disciplined processes. Process maturation, as assessed by the predictability of development outcomes in terms of quality, budget, and schedules is enhanced when feedback is meaningfully generated and utilized to recalibrate and fine tune the software process design. (4) Report evidence have suggested that organizations implementing a Capability Maturity Model-based software process improvement have realized gains in development cycle time and programmer productivity. (4) However Reports also suggest that organizations face difficulties in adhering to the sequence, as recommended by CMM, in which changes to the development process needs to be implemented. (4) In conclusion lack of theory informing the conceptualization of the Capability Maturing Model stages raises questions about the rationale for the suggested sequencing to develop process capabilities. Limited attention has been devoted to define process management, identify and define its constitutive dimensions, and develop reliable and valid measurement instruments for each of these dimensions. (4) Process improvement is one aspect of Total Quality Management that needs to be integrated with other core Total Quality Management principles, such as customer focus and viewing the organization with an integrated systems perspective. These essential aspects of Total Quality Management are currently missing in the Capability Maturity Model (CMM). (4) Integrative theory development is required to understand the relationships between process management practices and other elements of the development organization, which enable or constrain effective process management. (4) Generally the Capability Maturity Model recognizes that moving from a craft approach, where performance is largely a function of individual skills, to a factory approach, where the process plays a dominant role, is necessary to improve software development performance).
